law of China if he does such things which the Treaties do not allow.

Despite complaints, up to the 11th. February,, 1909, Sir J. Jorden did not consider that the circumstances brought to his notice would justify him in recommending the reversal of the 1904 regulations, and in fact Mr. Fox's Despatch to which Sir John Jordan was replying, nowhere states that trouble has actually arisen owing to class 3.

Kr. For mentions only three men by name, and nothing is said as to the class to which they belonged. Whatever it was, and even if they were in class 3, it was not on that ground that the Chinese questioned their British nationality.

12. Ho To-shang is in class 3 and he would probably be regarded as a deserving case, his father being a Christian and having resided in Hongkong from 1858 to 1872, while his mother was still resident in the Colony in 1909.

But as was justly pointed out at the time by the Governor,

Ho's case presented no difficulty.

13. Mr. Jamieson apparently met with difficulties

which he regarded as intolerable in connection with the

protection of persons in Class 3, but again it was pointed

out quite correctly by the Governor in Despatch No. 113 of

3rd. December, 1909, that these difficulties could be avoid-

-ed by sirmgly strict adherence to the recognised rules

and prixitsua principles governing such cases.

14. If it is these intolerable difficulties which form

the subject of Mr. Jamieson's despatch of the 17th. Decem- -ber, 1909, to Sir John Jordan, the exact difficulty seems

to have been the refusal of the axırmak Governor-

-General to seal passports issued to Un Kampwa, Yu To Sang and Li Kang. Un Kam-wa is in Class 2, Yu To Sang would have been regarded by Sir Henry Blake as a deserving case in Class 3, and Li Kang should never have been given a pacs-

-port.
